Terms of Use (Terms of Service)

These Terms of Use ("Terms") are a binding agreement between you ("you," "your," or "User") and Erdi Acar ("we," "us," "our," or "Developer"), the developer and owner of the mobile application Chess Defence (product id: com.erdiacar.chessDefence) (the "App"). By downloading, installing, accessing, or using the App (including any updates, patches, or new features), you agree to be bound by these Terms and any referenced policies (including our Privacy Policy). If you do not agree, do not use the App.

Platform availability: iOS (live) and Android (in progress). The App is offered globally; local laws may apply.

• Acceptance and Changes

• Acceptance: You accept these Terms by using the App. Your use constitutes agreement to these Terms and any policies incorporated by reference.

• Changes to Terms: We may modify these Terms for legal, operational, or business reasons. If we make material changes, we will provide notice (e.g., in-app notification or email) prior to the effective date. Continued use after the change constitutes acceptance. If you do not accept updated Terms, you must stop using the App and request account termination where available.
• Eligibility; Account Registration

• Eligibility: The App is not directed to children under 13. You must be at least the age permitted by applicable law in your jurisdiction (typically 13) and have legal capacity to enter contracts. If you are under the age required by local law, you may not use the App.

• Account: Some features require an account. You are responsible for providing accurate information, maintaining confidentiality of account credentials, and for all activity under your account.

• Prohibited: Sharing accounts in violation of rules, creating multiple accounts to abuse systems, using false information.
• License Grant and Intellectual Property

• License to Use App: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App on compatible devices for your personal, non-commercial entertainment.

• Developer IP: All rights, title and interest in and to the App, related content, source code, artwork, names, graphics, trademarks, trade dress, logos, and documentation are owned by us or our licensors and are protected by copyright, trademark, and other laws. Except for the limited license above, you receive no rights in our intellectual property.

• Third-Party IP: Third-party libraries, services, marks or content included in the App are owned by their respective owners and are licensed under separate terms.
• Acceptable Use and User Obligations

You agree not to:

• Use the App for illegal activities or in violation of applicable law.

• Modify, adapt, translate, decompile, disassemble, reverse engineer, or attempt to extract source code from the App (except where permitted by applicable law).

• Bypass, defeat, or tamper with security or anti-cheat protections.

• Use cheats, hacks, bots, automation, exploits, or third‑party software to modify or interfere with the App or other users' experience.

• Impersonate others, harass, stalk, threaten, or abuse other users, or post prohibited content (sexual content involving minors, hate speech encouraging violence, or other illegal content).

• Send unsolicited advertising, spam, or otherwise use the App to distribute malware.

Violation may result in suspension or termination of access, removal of content, and legal action.

• User-Generated Content; Community Features

• UGC Defined: If the App offers usernames, profile text, messaging, chat, screenshots, screenshots shared to community feeds, or other content created by users ("User Content" or "UGC"), you retain ownership of User Content you lawfully create, subject to the license below.

• License to Developer: By posting or submitting UGC, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, distribute, publicly display, perform, modify, adapt, and otherwise exploit such content for the purpose of operating, improving, promoting and distributing the App, including promotional and marketing purposes.

• Content Standards: You must not post UGC that is unlawful, infringing, defamatory, harassing, obscene, pornographic, hateful, or otherwise objectionable. You must not post personal data of third parties without consent.

• Moderation: We may monitor, moderate, remove or disable access to any UGC that violates these Terms, without prior notice and at our sole discretion. We reserve the right to suspend or terminate accounts that post prohibited content.

• Reporting: If you believe content violates rights or these Terms, contact us at erdiacar@gmail.com with details.
• Purchases, Subscriptions, Billing and Refunds

• Business Model: The App is freemium. It offers consumable in-app purchases (IAP), bundles, and subscription products. IAPs are processed through platform providers (Apple App Store, Google Play) and RevenueCat. Payment methods and billing are handled by the platform; you agree to platform terms when purchasing.

• Subscriptions: Where offered, subscriptions auto-renew at the renewal price stated at purchase (or then-current price). Subscriptions renew automatically until canceled. To cancel, follow the platform-specific instructions (App Store or Google Play) or contact platform support. Cancellation prevents future charges but does not typically retroactively refund prior periods.

• Restores and Consumables: Non-consumable purchases and subscriptions may be restorable via “Restore Purchases” functionality. Consumable items (e.g., gem packs or in-game consumables) are generally not restorable and are consumed on delivery. If you believe a consumable was not granted, contact support and provide transaction details.

• Refunds: We maintain a 14-day refund policy for purchases in territories where refunds are permitted and subject to platform rules and applicable law. Platform providers (Apple, Google) may handle refund requests directly. Refund eligibility is subject to our review and platform policies. To request a refund, contact us at erdiacar@gmail.com and provide proof of purchase. Refunds do not restore consumed virtual currency in all cases.

• Taxes: Prices exclude taxes; you are responsible for applicable taxes and duties.

• Billing Disputes: For IAP, billing disputes are subject to platform dispute processes. For direct subscription charges (if any) managed by third parties, follow their dispute procedures.
• Third-Party Services, Advertising and Analytics

• Third-Party Services: The App integrates third-party services including but not limited to RevenueCat (IAP management), Firebase Analytics and Google Analytics (analytics), AdMob (advertising), Supabase (cloud backend), and Crashlytics (crash reporting). Use of these services is subject to their terms and privacy policies.

• Ads and Rewarded Content: The App may display ads and provide rewards for viewing ads. Ads are provided by third-party ad networks. We are not responsible for the content or performance of those ads. Viewing rewarded ads may require connection to third-party ad SDKs and may collect device identifiers.

• Analytics and Data Collection: We collect and process analytics and diagnostic data (see our Privacy Policy). Telemetry helps us improve performance, balance, and product experience.

• Third-Party Links: The App may link to third-party sites; we are not responsible for their content or practices.
• Virtual Items and Currencies

• Virtual Economy: The App contains virtual currencies, items, and progression systems (e.g., Gems, Gold, Hero cards). Virtual items are for in‑game use only, have no monetary value outside the App, and are not redeemable for cash except where required by law.

• No Ownership: Purchases of virtual goods grant an in-app license to use virtual items but do not transfer ownership of the underlying intellectual property.

• Account and Purchases: Items associated with your account may be lost if you violate Terms or your account is terminated. We are not responsible for lost virtual items due to unauthorized access or user error.

• Abuse: Attempting to manipulate the economy (exploits, duplication, fraud) may result in account suspension and forfeiture of virtual goods.
• Privacy

• Privacy Policy: The Developer's Privacy Policy governs collection, use, and disclosure of personal data. By using the App you consent to our processing as described in that policy. Key tech: firebase_analytics, google_analytics, admob, supabase, crashlytics.

• Children: The App is not intended for children under applicable minimum age. If you believe a child has provided personal information without consent, contact us so we can take appropriate action.
• Warranty Disclaimer

• NO WARRANTY: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.

• NO GUARANTEES: We do not guarantee continuous, error-free operation, availability, or that the App will meet your requirements. We may modify, suspend, or discontinue features or services (including servers and online features) at any time.
• Limitation of Liability

• TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

• OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS IS LIMITED TO THE GREATER OF (A) USD $100 (ONE HUNDRED DOLLARS) OR (B) THE AMOUNT YOU PAID TO US FOR THE APP OR ANY IN‑APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY AMOUNT, OUR LIABILITY IS LIMITED TO USD $10 (TEN DOLLARS) WHERE APPLICABLE LAW REQUIRES A MINIMUM AMOUNT.
• Indemnification

• You agree to indemnify, defend and hold harmless Developer and its officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising from your use of the App, your breach of these Terms, your violation of applicable law, or your User Content.
• Suspension, Termination and Account Removal

• Suspension/Termination by Us: We may suspend or terminate your access, accounts, and content if you violate these Terms, pose security risks, or for business reasons. We will try to give notice where practicable but may act immediately for serious infractions.

• Termination by You: You may stop using the App at any time. To delete your account where supported, use in‑app settings or contact erdiacar@gmail.com. Some data may be retained for legal or legitimate business reasons.

• Effect: Upon termination, we may delete or disable access to your account and content. Termination does not relieve you of obligations incurred prior to termination.
• Dispute Resolution and Governing Law

• Governing Law: These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles.

• Venue and Jurisdiction: Except where mandatory law provides otherwise, disputes will be subject to the exclusive jurisdiction of the courts located in Istanbul, Turkey.

• Alternative Dispute Mechanisms: Where required by local law, you may have the right to bring certain claims in small claims court. The above choice of law does not override mandatory consumer protections where you reside.
• Export Control and Compliance

• You shall comply with all applicable export and import laws and may not access, download or use the App in violation of any export restrictions. You may not use the App in sanctions-restricted countries in violation of applicable law.
• DMCA and Copyright

• Copyright: If you believe your copyright is infringed by User Content hosted by us, please provide notice to us with the following: (i) identification of the copyrighted work; (ii) identification of the infringing material and its location; (iii) your contact information; (iv) a statement of good faith; and (v) a signature (physical or electronic). Send notices to erdiacar@gmail.com and our address above. We will respond in accordance with applicable law.

• If you are a repeat infringer, we may terminate accounts.
• Notices; Electronic Communications

• Notices to you may be provided through the App, email, or posted on our website. You consent to receive electronic communications for these purposes.
• Promotions, Contests and Leaderboards

• Promotions: Any promotions or in‑App contests are subject to separate rules and may be void where prohibited. Winners may be required to provide additional information for prize fulfillment.

• Leaderboards: Leaderboard placement is governed by game rules; manipulation may result in removal.
• Severability, Waiver, Assignment

• Severability: If any provision is unenforceable, the remainder remains in force.

• Waiver: Failure to enforce a right is not a waiver of that right.

• Assignment: We may assign these Terms and our rights; you may not assign your rights without our consent.
• Entire Agreement

• These Terms, the Privacy Policy, and any other referenced policies constitute the entire agreement between you and Developer concerning the App.
• Special Platform Terms (App Store & Google Play)

• App Store: The App is distributed via Apple App Store. You acknowledge and agree that these Terms do not supersede Apple terms, and Apple is not a party to these Terms. Purchases made via App Store are governed by Apple policies. To manage or cancel subscriptions purchased with your Apple ID, use your Apple ID account settings (or the instructions Apple provides for subscription management). Apple is not responsible for the App, related content, or any claims arising from the App, except as required by Apple’s own policies or applicable law.

• Google Play: Where the App is distributed via Google Play, these Terms do not supersede Google’s terms, and Google is not a party to these Terms. Purchases made via Google Play are governed by Google policies. To manage or cancel subscriptions purchased through Google Play, use your Google account subscription settings (or the instructions Google provides). Google is not responsible for the App, related content, or any claims arising from the App, except as required by Google’s own policies or applicable law.

• Platform Priority: If there is a conflict between these Terms and mandatory Platform Provider terms that apply to your download or purchase, the Platform Provider terms control solely to the extent of that conflict and solely as required by the Platform Provider or applicable law.
