This Disclaimer governs your use of the mobile application Chess Defence (product ID com.erdiacar.chessDefence) and any related content, services, functionality, updates, and communications provided by Erdi Acar ("we", "us", or "Developer"). By downloading, installing, or using Chess Defence you acknowledge and accept the terms of this Disclaimer. If you do not agree with this Disclaimer, do not download or use the app.
1. Scope
This Disclaimer applies to the Chess Defence mobile application on iOS (live) and Android (in progress), and to all content and services delivered in or via the app, including game mechanics, progression systems, in-app purchases (IAP), advertising, analytics, remote level catalogs, and any live operations. It covers express statements made in the app and any other documentation or communications intended for users.
2. General Disclaimers
- The content, features, economy parameters, balance values, item descriptions, and functionality of Chess Defence are provided "as is" and may change at any time without notice as part of normal product development, live-ops, or required fixes.
- Any examples, illustrations, screenshots, or descriptions of gameplay, items, bundles, or offers are for informational purposes only and are subject to live configuration. Actual experience may vary.
- We do not guarantee continuous, error-free, or secure operation. The app may be unavailable temporarily or permanently for maintenance, updates, or for reasons beyond our control.
3. No Warranties
To the fullest extent permitted by applicable law, Chess Defence and all materials and services provided through it are furnished "as is", "with all faults", and "as available". The Developer expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to the following:
- Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement;
- Any warranty that the app will meet your requirements, be compatible with your device, operate without interruption, or be free of bugs, errors, or malware;
- Any warranty as to the accuracy, completeness, or reliability of information presented in the app.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you to the extent prohibited by law.
4. Limitation of Liability
To the maximum extent permitted by applicable law:
- Neither the Developer nor its officers, employees, contractors, or affiliates will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, loss of data, loss of use, business interruption) arising out of or related to your use of the app, even if advised of the possibility of such damages.
- The Developer’s aggregate liability for claims relating to Chess Defence will not exceed the amount you actually paid the Developer for the app or, if you paid nothing, fifty U.S. dollars (US$50), or such greater amount as required by applicable law.
- These limits apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or any other legal theory.
Nothing in this section is intended to exclude or limit liability that cannot be excluded or limited by applicable law (for example, liability for death or personal injury resulting from negligence in some jurisdictions).
5. External Links & Third‑Party Services
- Chess Defence integrates or links to third‑party services and technologies which are separate from the Developer’s operations, including but not limited to Firebase Analytics, Google Analytics, Apple IAP (via RevenueCat), AdMob, Supabase, and Crashlytics. These third parties have their own terms, privacy policies, and practices. Your use of those services is subject to their terms and policies.
- The Developer is not responsible for the content, services, privacy practices, or performance of any third party. Links, ads, or third‑party content shown in the app do not imply endorsement.
- Advertisements and rewarded content are provided by third-party ad networks. Rewards, availability, and content quality are controlled by those networks and may vary; the Developer is not responsible for ad content or ad delivery failures.
- In-app purchases are processed by the platform provider (e.g., Apple App Store) and/or through RevenueCat. Refunds, billing disputes, and certain purchase policies are governed by those providers.
6. Professional Advice Disclaimer
The content in Chess Defence is for entertainment and general informational purposes only. It does not constitute professional advice of any kind.
- Medical / Health: This app is not a health or medical application. Chess Defence does not provide medical diagnosis, treatment, or recommendations. If you have a medical condition, mental health concern, or questions related to health, consult a licensed healthcare professional. The app is not a substitute for professional medical care.
- Financial / Tax / Investment: Chess Defence does not provide financial, investment, tax, or accounting advice. Any in-game references to currencies, prices, or economics are part of game mechanics and should not be relied upon for real-world financial decisions. Consult a qualified financial or tax professional for advice.
- Legal: Nothing in the app constitutes legal advice. For legal matters seek a licensed attorney.
- Educational: Any tutorial, explanation, or in-game guidance is intended for entertainment and basic instruction only. It does not replace formal education, accredited training, or professional courses.
- AI & Automated Systems: If any AI, machine learning, or automated decision tools are used in the app or backend, their outputs are probabilistic and not guaranteed to be accurate, complete, or up to date. Decisions based on automated outputs should be reviewed by a human. The Developer is not responsible for consequences arising from reliance on AI-generated content.
If a feature of Chess Defence provides domain‑specific guidance (for example, strategy tips, heuristics, or simulated scenarios), treat it as game-related commentary, not authoritative professional advice.
7. Accuracy of Information
- We strive for accuracy in descriptions of game mechanics, pricing, and features; however, errors, omissions, or outdated information may occur. We may update content at any time without prior notice.
- Online/config-driven elements (for example, level catalogs, reward tables, difficulty settings) are subject to remote updates. The Developer is not responsible for temporary inconsistencies between local app files and server-side configuration during updates or outages.
- Screenshots, promotional materials, and store listings may depict pre-release or art assets that differ from the live product.
8. Game‑Specific Disclaimers
- Gameplay & Progression: Chess Defence is designed as a long-term progression game. Progression speed, success in levels, and outcomes depend on player skill, strategy, and in-game decisions. While spending real money may accelerate progression, it does not guarantee victory or specific outcomes in gameplay.
- In-App Purchases (IAP): Purchases are final and processed by the platform provider. Consumable purchases are typically non-restorable; non-consumable purchases and subscriptions are subject to platform restore/refund mechanisms. The Developer will follow platform policies regarding purchase validation and fulfillment.
- Rewards & Monetization: Offers, gem packs, chests, and bundles are subject to availability and may change. Any stated contents are subject to the live configuration at the time of purchase. Promotional pricing and special offers are time-limited and may be modified or removed without notice.
- Ads & Rewarded Content: Reward availability is subject to third-party ad inventory and policies. Repeated attempts to obtain rewards may be limited to prevent abuse. Watching an ad does not guarantee reward delivery if an ad fails to complete.
- Multiplayer / Social Features: If any social, multiplayer, or online features are present or introduced, they may involve interactions with other users. We are not responsible for conduct, content, or transactions between players.
9. Data, Analytics & Privacy
- We use analytics and crash-reporting services to improve the product. These services may collect device, usage, and diagnostic data. Information is handled in accordance with the app’s Privacy Policy and the third-party providers’ privacy practices.
- By using the app you consent to collection and processing of data as described in the Privacy Policy and in the terms of third-party services.
10. Intellectual Property
- All game assets, code, designs, trademarks, and content in Chess Defence are the property of the Developer or third-party licensors and are protected by applicable intellectual property laws. You may not copy, redistribute, modify, create derivative works from, or otherwise use our intellectual property except as expressly permitted in-app or by license.
- "Chess Defence", logos, and other product identifiers are trademarks of the Developer. The use of chess piece mechanics and generic chess moves as gameplay concepts does not confer any right to copy the Developer’s specific assets or content.
11. Updates, Changes & Termination
- We may modify, suspend, or terminate any feature, service, or the app itself at any time, with or without notice. We may also change this Disclaimer by posting a revised version in the app or on our website. The Effective Date at the top indicates when the current version became effective.
- Continued use of the app after changes constitutes acceptance of the revised Disclaimer.
12. Governing Law & Dispute Resolution
- This Disclaimer is governed by the laws of the jurisdiction in which the Developer is established, except where local consumer protection laws require otherwise. Where applicable law requires a specific governing law or forum, such requirement shall control.
- Certain jurisdictions may provide users with rights that cannot be waived. Nothing in this Disclaimer is intended to limit those rights.
13. Severability
If any provision of this Disclaimer is found to be invalid, illegal, or unenforceable under applicable law, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
